सोशल इन्फ्लूएंसर्स को सरकार ने दी चेतावनी, सट्टेबाजी और जुए को प्रमोट भारी (Government warns social influencers to promote betting and gambling)

सूचना एवं प्रसारण मंत्रालय (एमआईबी) ने सोशल मीडिया पर विज्ञापनदाताओं और इन्फ्लूएंसर्स के लिए एडवाइजरी जारी है. सरकार ने इन्फ्लूएंसर्स को विदेशी ऑनलाइन सट्टेबाजी और जुआ प्लेटफॉर्म्स का प्रचार से रोकने की सलाह दी है. गाइडलाइन्स जारी है कि इसके विज्ञापनों का लोगों पर बुरा असर है. खासकर युवाओं पर बुरा असर है. सूचना एवं प्रसारण मंत्रालय ने खुद जानकारी दी है. मंत्रालय नेएक्स (पूर्व में ट्विटर) पर पोस्ट कर एडवाइजरी जारी है. 

The Ministry of Information and Broadcasting (MIB) has issued advisory for advertisers and influencers on social media. The government has advised influencers to stop promoting foreign online betting and gambling platforms. The guidelines continue that its advertisements have a bad effect on people. It is especially a bad influence on the youth. The Ministry of Information and Broadcasting itself has given the information. The ministry continues to issue advisories by posting them on Nex (formerly Twitter).

एडवाइजरी :- मंत्रालय ने ऑनलाइन विज्ञापन दिखाने वाली कंपनियों को कहा है कि वे भारतीय दर्शकों को ऑनलाइन सट्टेबाजी और जुआ प्लेटफॉर्म्स को प्रोमोट करने वाले विज्ञापन न दिखाएं. सोशल मीडिया प्लेटफॉर्मों को ऐसे कंटेंट को पब्लिश न के लिए जागरूक करना चाहिए. 

Advisory: The Ministry has asked online advertising companies not to show advertisements promoting online betting and gambling platforms to Indian audiences. Social media platforms should be made aware not to publish such content.

सजा :-सूचना एवं प्रसारण मंत्रालय ने एडवाइजरी में बताया है कि इन गाइडलाइन्स का पालन न पर क्या हो सकता है. सलाह न मानने वाले व्यक्ति और संस्था के खिलाफ सजा प्रावधान है. कोई कंपनी या व्यक्ति इस सलाह को नहीं मानता है, तो उस खिलाफ उपभोक्ता संरक्षण अधिनियम, 2019 के तहत कार्रवाई की जा सकती है. उस व्यक्ति या कंपनी को सोशल मीडिया पोस्ट या अकाउंट बंद या जुर्माने जैसी सजा हो सकती है. 

Punishment:- The Ministry of Information and Broadcasting has told in the advisory what can happen if these guidelines are not followed. There is a provision for punishment against the person and organization who do not follow the advice. If any company or person does not follow this advice, action can be taken against it under the Consumer Protection Act, 2019. That person or company may face punishment like closure of social media post or account or fine.

कार्रवाई :-सरकार ने स्पष्ट किया है कि सूचना प्रौद्योगिकी अधिनियम, 2000 की धारा 79 के तहत सोशल मीडिया कंपनियों को दूसरों द्वारा डाले कंटेंट के लिए जिम्मेदार नहीं ठहराता है. लेकिन, सरकार को पता चलता है कि सोशल मीडिया प्लेटफॉर्म पर जुआ या सट्टेबाजी का प्रचार है तो कंपनी को वो कंटेंट हटाने के लिए कह सकती है. अगर कंपनी ऐसा नहीं करती है तो कार्रवाई हो सकती है.

Action: The government has clarified that under Section 79 of the Information Technology Act, 2000, social media companies are not held responsible for the content posted by others. But, if the government comes to know that there is promotion of gambling or betting on a social media platform, then it can ask the company to remove the content. If the company does not do this then action can be taken.

दोहराया :-मंत्रालय ने सेंट्रल कंज्यूमर प्रोटेक्शन अथॉरिटी (सीसीपीए) की 6 मार्च 2024 की सलाह को दोहराया है. सीसीपीए ने मशहूर सेलिब्रिटीज और प्रभावशाली द्वारा सट्टेबाजी और जुआ प्लेटफॉर्म्स के विज्ञापन पर चिंता जताई थी और चेतावनी थी कि विज्ञापन की कड़ी जांच की जाएगी.

Repeated:-The Ministry has reiterated the advice of the Central Consumer Protection Authority (CCPA) dated March 6, 2024. The CCPA had expressed concern over the advertising of betting and gambling platforms by celebrities and influencers and warned that advertising would be subject to strict scrutiny.

प्रोत्साहित :-हाल ही में कुछ दिनों पहले प्रधानमंत्री मोदी ने सोशल मीडिया पर अच्छा काम और लोगों को प्रोत्साहित वाले सोशल मीडिया इन्फ्लूएंसर्स को अवॉर्ड देकर प्रोत्साहिता था. सोशल मीडिया पर कुछ ऑनलाइन सट्टेबाजी और जुए के प्लेटफॉर्म को प्रमोट करते है, जिन लिए सरकार ने चेतावनी जारी की है. 

Encouraged: - Recently, a few days ago, Prime Minister Modi had encouraged social media influencers by giving them awards for doing good work on social media and encouraging people. Some promote online betting and gambling platforms on social media, for which the government has issued a warning.
