एमपी हाईकोर्ट ने एलएलबी में 50% स्कोर पर सिविल जज रिक्रूटमेंट टेस्ट (MP High Court Civil Judge Recruitment Test on 50% score in LLB)

एमपी हाईकोर्ट की एक डिवीजन बेंच ने सिविल जज रिक्रूटमेंट टेस्ट देने की योग्यता में सुनवाई ओबीसी कैंडिडेट्स के हक में फैसला सुनाया है। अब एलएलबी में कम से कम 50% मार्क्स स्कोर वाले ओबीसी कैंडिडेट्स सिविल जज रिक्रूटमेंट टेस्ट के लिए एलिजिबल होंगे। पहले ओबीसी कैंडिडेट्स की एग्जाम देने के लिए एलिजिबिलिटी यूआर (जनरल) के बराबर थी।

A division bench of the MP High Court has ruled in favor of OBC candidates hearing the eligibility test for Civil Judge Recruitment Test. Now OBC candidates with at least 50% marks score in LLB will be eligible for Civil Judge Recruitment Test. Earlier, the eligibility of OBC candidates to appear in the exam was equal to UR (General).

पहले एग्जाम देने के लिए यूआर और ओबीसी दोनों कैटेगरी के एलएलबीएग्जाम में कम से कम 70% स्कोर जरूरी था। ये भारतीय संविधान के आर्टिकल 14 और 16 (4) और रिजर्वेशन रूल्स 1994 के खिलाफ है। वहीं, एससी/एसटी के लिए ये योग्यता 50% की थी।

Earlier, to appear in the exam, at least 70% score in LLB exam for both UR and OBC categories was required. This is against Articles 14 and 16 (4) of the Indian Constitution and Reservation Rules 1994. Whereas for SC/ST this qualification was 50%.

हाई कोर्ट के फैसले के बाद अब एलएलबीएग्जाम में 50% स्कोर हासिल किए ओबीसी कैंडिडेट्स भी सिविल जज रिक्रूटमेंट टेस्ट दे सकेंगे। कोर्ट ने हाईकोर्ट के रजिस्ट्रार जनरल को सिविल जज भर्ती एग्जाम में हुए बदलाव के लिए तीन दिनों के अंदर नोटिफिकेशन जारी के निर्देश दिए हैं।

After the decision of the High Court, now OBC candidates who have secured 50% score in LLB exam will also be able to appear for Civil Judge Recruitment Test. The court has directed the Registrar General of the High Court to issue notification within three days for the changes in the Civil Judge Recruitment Exam.

एग्जाम नोटिफिकेशन :-एमपी हाईकोर्ट का एग्जामिनेशन सेल ये एग्जाम कंडक्ट है। दरअसल, इस साल 17 नवंबर को हाईकोर्ट की सिफारिश पर राज्य सरकार ने इस एग्जाम के लिए नोटिफिकेशन जारी था। नोटिफिकेशन में टेस्ट के लिए योग्यता नियमों में कई बदलाव किए थे। मध्य प्रदेश के नरसिंहपुर जिले से एडवोकेट वर्षा पटेल ने इन बदलावों को गैरकानूनी बताते हुए इस खिलाफ कोर्ट में याचिका दायर थी।

Exam Notification:-This exam is conducted by the Examination Cell of MP High Court. Actually, on November 17 this year, on the recommendation of the High Court, the state government had issued the notification for this exam. Many changes were made in the eligibility rules for the test in the notification. Advocate Varsha Patel from Narsinghpur district of Madhya Pradesh had filed a petition in the court against these changes, calling them illegal.

नियमों के खिलाफ याचिका :-नए नियमों के मुताबिक वो एलएलबी एग्जाम में कम से कम 70% स्कोर नहीं हो, वो कम से कम तीन सालों की प्रैक्टिस के बाद ही एग्जाम देगे।,रिटेन टेस्ट में मेरिट लिस्ट में कोई रैंक मिली हो, लेकिन वो अपॉइंटमेंट के लिए एलिजिबल होगा अगर उसने 50 मार्क्स के इंटरव्यू में कम से कम 20 नंबर हासिल हों।,एग्जाम के लिए यूआर और ओबीसी के लिए एलिजिबिलिटी क्राइटेरिया बराबर है, जो गैर कानूनी है।, चीफ जस्टिस मलिमथ और जस्टिस मिश्रा ने बुधवार को केस की सुनवाई के दौरान एमपी हाईकोर्ट के रजिस्ट्रार जनरल और लॉ डिपार्टमेंट से इस मामले में 24 घंटे में जवाब मांगा था। लेकिन, शुक्रवार तक सुनवाई से पहले रजिस्ट्रारसे कोई जवाब नहीं आया।

Petition against the rules: - According to the new rules, those who should not have at least 70% score in the LLB exam, will appear in the exam only after at least three years of practice. If they have got any rank in the merit list in the written test, but He will be eligible for appointment if he has secured at least 20 marks in the interview out of 50 marks. The eligibility criteria for the exam are the same for UR and OBC, which is illegal.During the hearing of the case on Wednesday, Chief Justice Malimath and Justice Mishra had sought a reply from the Registrar General and Law Department of MP High Court in this matter within 24 hours. But, no response was received from the registrar before the hearing till Friday.

इस बाद हाईकोर्ट ने याचिका पर सुनवाई करते हुए सिविल जज रिक्रूटमेंट टेस्ट के लिए ओबीसी कैंडिडेट्स के लिए एलएलबी एग्जाम में 70% मार्क्स क्राइटेरिया को घटाकर 50% कर दिया है।

After this, the High Court, while hearing the petition, has reduced the 70% marks criteria in LLB exam to 50% for OBC candidates for Civil Judge Recruitment Test.
