'18 महीने का डिप्लोमा 2 साल की डिग्री के बराबर नहीं', सुप्रीम कोर्ट के फैसले पर बदला रिजल्‍ट ('18 months diploma is not equal to 2 years degree', result changed on Supreme Court's decision)

सुप्रीम कोर्ट ने 28 नवंबर को एक महत्वपूर्ण फैसला सुनाते कहा कि नेशनल इंस्टीट्यूट ऑफ ओपन स्कूलिंग यानी एनआईओएस से किया,18 महीने का डी.ई.एल.एड. डिप्लोमा कोर्स 2 साल के रेगुलर डिप्लोमा के बराबर नहीं है। सुप्रीम कोर्ट ने यह कहा कि नेशनल काउंसिल फॉर टीचर एजुकेशन यानी एनसीटीई ने एनआईओएस के 18 महीने के डिप्लोमा को टीचर्स रिक्रूटमेंट के लिए एलिजिबिलिटी में मान्यता नहीं दी है।

The Supreme Court gave an important decision on November 28 and said that the 18-month D.El.Ed. was done from the National Institute of Open Schooling i.e. NIOS. Diploma course is not equivalent to 2 years regular diploma. The Supreme Court said that the National Council for Teacher Education (NCTE) has not recognized the 18-month diploma of NIOS as eligibility for teachers' recruitment.

केवीएस लिस्ट रिवाइज :- सुप्रीम कोर्ट के फैसले के बाद केंद्रीय विद्यालय संगठन ने भी नोटिस जारी कर दिया है। दरअसल, 28 नवंबर 2023 को केवीएस की ओर से प्राइमरी स्कूल टीचर्स के लिए सिलेक्टेड कैंडिडेट्स की एक लिस्ट जारी की थी। कोर्ट के इस फैसले के आते है केवीएस ने अपना फैसला बदल दिया। संगठन ने नोटिस में कहा कि कोर्ट के फैसले के मद्देनजर डी.ई.एल.एड. डिग्री धारक प्राइमरी टीचर बनने के लिए एलिजिबल नहीं है। अब केवीएस लिस्ट को जांच कर एक नई लिस्ट जारी करेगा।

KVS List Revision:- After the decision of the Supreme Court, Kendriya Vidyalaya Sangathan has also issued notice. Actually, on 28 November 2023, KVS had released a list of selected candidates for primary school teachers. After this decision of the court, KVS changed its decision. The organization said in the notice that in view of the court's decision, D.El.Ed. Degree holders are not eligible to become primary teachers. Now KVS will check the list and release a new list.

मामला :- दरअसल, नैनीताल हाईकोर्ट ने यह फैसला सुनाया था कि एनआईओएस से किया 18 महीने का डिप्लोमा कोर्स 2 साल के डिप्लोमा डिग्री के बराबार है। इस बाद उत्तराखंड सरकार और जयवीर सिंह व अन्य ने सुप्रीम कोर्ट में इस फैसले के खिलाफ याचिका दायर की। सुप्रीम कोर्ट की जस्टिस BR गवई और प्रशांत कुमार मिश्रा की पीठ ने यह याचिका स्वीकार की और नैनीताल हाईकोर्ट के फैसले को रद्द कर दिया। सुप्रीम कोर्ट ने कहा कि हाईकोर्ट का यह कहना कि 18 महीने का डिप्लोमा और 2 साल का डिप्लोमा डिग्री बराबर है, पूरी तरह से गलत है।

Case:- Actually, Nainital High Court had ruled that the 18-month diploma course done from NIOS is equivalent to a 2-year diploma degree. After this, Uttarakhand government and Jaiveer Singh and others filed a petition against this decision in the Supreme Court. The bench of Supreme Court Justice BR Gavai and Prashant Kumar Mishra accepted this petition and canceled the decision of Nainital High Court. The Supreme Court said that the High Court's statement that 18 months diploma and 2 years diploma degree is equivalent is completely wrong.

एनसीटीई के नियम :-पीठ ने कहा कि एनसीटीई ने 23 अगस्त 2010 और 29 जुलाई 2011 को जारी नोटीफिकेशन में कहा है कि शिक्षक भर्ती के लिए कैंडिडेट के पास कम से कम 2 साल का डिप्लोमा जरूरी है। नोटीफिकेशन्स में 18 महीने के डिप्लोमा को योग्यता में स्वीकार करने की बात कहीं नहीं है।

NCTE rules:- The bench said that NCTE has said in the notifications issued on 23 August 2010 and 29 July 2011 that for teacher recruitment, it is necessary for the candidate to have a diploma of at least 2 years. There is no mention in the notifications of accepting 18 months diploma as qualification.

फैसले का असर :-इस फैसले का असर 18 महीने के डिप्लोमा के बेसिस पर नौकरी कर रहे शिक्षकों पर नहीं होगी। नौकरी वैसी की वैसी ही रहेगी। इसका असर उन पर भी नहीं पड़ेगा जो किसी टीचर्स भर्ती के लिए 18 महीने के डिप्लोमा के आधार पर अप्लाय कर चुके हैं और भर्ती का प्रोसेस शुरू है। इस फैसले का असर होने वाली नई शिक्षक भर्ती पर पड़ेगा।

Impact of the decision:- This decision will not affect the teachers doing jobs on the basis of 18 months diploma. The job will remain the same. This will also not affect those who have applied for teachers recruitment on the basis of 18 months diploma and the recruitment process has started. This decision will affect the new teacher recruitment.

हाईकोर्ट राहत :- वहीं इलाहाबाद हाईकोर्ट ने 69000 शिक्षक भर्ती में स्‍टूडेंट्स को राहत दी है। कोर्ट ने 28 नवंबर को फैसला सुनाते हुए कहा कि भर्ती परीक्षा में पूछे गलत सवालों पर आयोग को स्‍टूडेंट्स को पूरे नंबर देगे। आयोग अब 2 महीने में इस भर्ती की मेरिट लिस्‍ट तैयार करेगा और ज्‍वाइनिंग लेटर जारी करेगा।

High Court Relief:- Allahabad High Court has given relief to the students in the recruitment of 69000 teachers. While giving its verdict on November 28, the court said that the commission will give full marks to the students on wrong questions asked in the recruitment examination. The Commission will now prepare the merit list of this recruitment in 2 months and issue the joining letter.
