पार्टनर को किस करना गैर-कानूनी है? जान लें नियम (Is it illegal to kiss a partner? know the rules)

ऐसे कई मामले सामने हैं, जहां कार में किस करने को लेकर पुलिस ने कपल्स को गिरफ्तार है. लेकिन, क्या वाकई कार में करना अपराध है? बहुत से  मन में यह सवाल है. इसीलिए, चलिए जुड़े नियम में बताते हैं. दरअसल, कार में किस करने या न करने को लेकर कोई सीधा कानून नहीं है. लेकिन, आईपीसी धारा 294 के हवाले से विवेक इस्तेमाल कर समझा जा सकता है.

There are many such cases where police have arrested couples for kissing in the car. But, is it really a crime to do in the car? This is the question in many minds. That's why, let's tell in the attached rule. Actually, there is no direct law regarding what to do or not to do in the car. But, quoting IPC section 294 can be understood using discretion.

 धारा 294

अगर भारतीय दंड संहिता की धारा 294 के अनुसार, यदि कोई व्यक्ति सार्वजनिक जगह पर किसी तरह की अश्लील हरकत या गंदा काम करता है, जिसे वहां लोगों द्वारा अश्लील माना है, तो इसे भारतीय दंड संहिता की धारा 294 के तहत अपराध माना जाएगा. व्यक्ति (जो अश्लील हरकत ) दंड का हकदार होगा. उसे भारतीय दंड संहिता की धारा 294 के प्रावधानों के अनुसार दंड दिया जाएगा. 

If according to section 294 of the Indian Penal Code, if a person does any kind of obscene act or dirty work in a public place, which is considered obscene by the people there, then it will be considered an offense under section 294 of the Indian Penal Code. The person (who indulges in obscene act) shall be entitled to punishment. He will be punished as per the provisions of section 294 of the Indian Penal Code.

हालांकि, यह जमानती धारा है. यानी, गिरफ्तार हुए अपराधी को जमानत पर रिहा किया  है. भारतीय दंड संहिता की धारा 294 सार्वजानिक स्थानों पर अश्लील कामों के अपराध को परिभाषित के साथ-साथ सजा को निर्धारित है. दोषी को साधारण कारावास की सजा होती है, जो 3 महीने तक की है. इस अपराध में आर्थिक दंड का प्रावधान है, जो न्यायालय मामले की गंभीरता और आरोपी के इतिहास को ध्यान में निर्धारित है. 

However, this is a bailable section. That is, the arrested criminal is released on bail. Section 294 of the Indian Penal Code defines the crime of obscene acts in public places as well as the punishment. Under this, the guilty is punished with simple imprisonment, which is up to 3 months. There is a provision of monetary punishment in this crime, which is determined by the court keeping in mind the seriousness of the case and the history of the accused.

दिल्ली हाई कोर्ट के वकील कटियार ने कहा कि 'अगर कार पब्लिक प्लेस में है और आस-पास लोग हैं, तब कोई कार में किस करता है, जिससे लोग चिढ़ जाएं और वह अश्लील मानें, तो यह आईपीसी की धारा 294 के तहत अपराध की कैटेगरी में है. लेकिन, कई अन्य फैक्टर रहते हैं, जिन्हें ध्यान में रखता है.'

Delhi High Court lawyer Katiyar said that 'if the car is in a public place and there are people around, then someone kisses in the car, which irritates the people and they consider it obscene, then it amounts to an offense under section 294 of the IPC. is in the category. But, after that there are many other factors, which have to be kept in mind.
