ट्रेन रिजर्वेशन के बावजूद नहीं मिली सीट, रेलवे देगा 1 लाख हर्जाना (Seat not found despite train reservation, Railways will pay 1 lakh damages)

रिजर्वेशन के बावजूद बुजुर्ग को सीट न देना रेलवे को भारी पड़ा. आयोग ने रेलवे को हर्जाने के रूप में एक लाख रुपये पीड़ित यात्री को देने का आदेश है. 14 साल पुराने इस मामले में बिहार के बुजुर्ग यात्री झा रिजर्वेशन के बावजूद ट्रेन में बर्थ नहीं थी और बिहार से दिल्ली की यात्रा खड़े-खड़े करनी थी.

Despite the reservation, the railways suffered heavy for not giving seats to the elderly. The commission has ordered the Railways to pay one lakh rupees as compensation to the aggrieved passenger. In this 14-year-old case, Bihar's elderly passenger Jha did not have a berth in the train despite the reservation and the journey from Bihar to Delhi had to be made standing.

2008 मामला (2008 case)

दिल्ली के दक्षिण जिला निवारण आयोग ने झा की शिकायत पर ईस्ट सेंट्रल रेलवे के जनरल मैनेजर को यह हर्जाना देने का आदेश है. झा ने फरवरी 2008 में दरभंगा से दिल्ली की यात्रा के लिए टिकट बुक थी, लेकिन रिजर्वेशन के बावजूद बर्थ नहीं गई.  

The South District Redressal Commission of Delhi has ordered to pay this compensation to the General Manager of East Central Railway on the complaint of Jha. Jha had booked a ticket for the journey from Darbhanga to Delhi in February 2008, but despite the reservation, the berth did not go.

सीट अपग्रेड (Seat upgrade)

आयोग ने आरामदायक यात्रा के लिए ही एडवांस में रिजर्वेशन हैं, शिकायतकर्ता को इस यात्रा में मुश्किलों का सामना था. ऐसे में हर्जाना मिलना ही चाहिए. रेल अधिकारियों ने झा की कन्फर्म टिकट किसी और को बेच थी. इस बारे में टीटीई से पूछा तो उन्हें बताया कि स्लीपर क्लास में सीट को एसी में अपग्रेड है, लेकिन झा वहां पहुंचे तो ट्रेन अधिकारियों ने बर्थ भी नहीं दी. दरभंगा से दिल्ली की यात्रा खड़े करनी पड़ी.

The Commission has reservations in advance only for comfortable travel, the complainant was facing difficulties in this journey. In such a situation, compensation should be given. Railway officials had sold Jha's confirmed ticket to someone else. When asked about this, TTE told him that the seat in the sleeper class has been upgraded to AC, but when Jha reached there, the train officials did not even give a berth. The journey from Darbhanga to Delhi had to be done standing.

रेलवे ने गलती (Railway's mistake)

रेलवे ने बचाव करते हुए इस मामले में कोई गलती नहीं थी. झा ने बोर्डिंग पॉइंट पर ट्रेन नहीं पकड़ी और पांच घंटे बाद किसी और स्टेशन पर ट्रेन पकड़ी. टीटीई को लगा कि वह ट्रेन में सवार नहीं हुए हैं और नियमों के यह सीट वेटिंग पैसेंजर गई. आयोग ने अधिकारियों की दलील को नहीं माना. 

While defending the Railways, there was no mistake in this matter. It was argued that Jha did not catch the train at the boarding point and after five hours caught the train at some other station. The TTE felt that he had not boarded the train and as per the rules this seat went to the waiting passenger. The commission did not accept the argument of the officers.

रेलवे की लापरवाही (Negligence of railways)

आयोग ने कहा कि स्लीपर क्लास के टीटीई ने एसी के टीटीई को बताया था कि पैसेंजर ने ट्रेन पकड़ ली है और बाद में पहुंचेंगे.रिजर्वेशन के बावजूद कोई बर्थ नहीं दी और बिना सीट के यात्रा करनी पड़ी. किसी यात्री को रिजर्व बर्थ पर का अधिकार है और औपचारिकता की जरूरत नहीं है. यदि बर्थ अपग्रेड कर दी थी तो बर्थ मिलनी चाहिए थी. रेलवे की लापरवाही का मामला है. 

The commission said that the TTE of sleeper class had told the TTE of AC that the passenger had caught the train and would reach later. Despite reservation, no berth was given and had to travel without a seat. A passenger has the right to reserve berth and no formality is required. If the berth had been upgraded, then the berth should have been given. It is a matter of negligence of railways.
